The courts have been overwhelmingly clear - the display of the Ten Commandments IS CONSTITUTIONAL particularly when shown in the same context as the Bill of Rights, the Magna Carta, and the Constitution, to demonstrate their critical roles in the historical development of law.

The U.S. Supreme Court recently turned down an opportunity to hear a Ten Commandments case out of Elkhart, Indiana ... but not without Chief Justice William H. Rehnquist speaking clearly about the constitutional implications of such a display:

"Indeed, a carving of Moses holding the Ten Commandments, surrounded by representations of other historical legal figures, adorns the frieze of the south wall of our courtroom, and we have said that the carving 'signals respect not for great proselytizers but for great lawgivers.'"

The ACLU persists in their attempts to convince judges that you, your schools, your judiciary, and your government have no right to display the Ten Commandments in public!

One man's actions could destroy two centuries of tradition in the United States Congress.

California lawyer Michael Newdow is suing members of Congress for employing chaplains! (Remember, he is challenging the Pledge of Allegiance, too.)

* A nine-person federal jury agreed with our 1998 lawsuit that Minnesota officials violated the constitutional rights of state employees by punishing them for reading their Bibles during a state-mandated diversity training session.

* After the American Center filed a lawsuit against a Dallas, Texas, school district, citing violations of the First Amendment of the U.S. Constitution, the district agreed to change its policy prohibiting employees from sending religious messages through the district e-mail system.

* U.S. District Court granted a preliminary injunction against a New York City Housing Authority's religious discriminatory policy. The American Center filed suit after the Housing Authority denied a Christian pastor's request to use a public housing facility for prayer and grief counseling after September 11. The Court called the city's denial "not reasonable."

* A three-judge panel of the U.S. Court of Appeals for the Ninth Circuit ruled that a Washington state school district violated the Equal Access Act of 1984 and the Free Speech Clause of the First Amendment when it refused to recognize a student-led, student-initiated Bible club because it was "religious." The American Center represented the student in this case of discrimination.

* The American Center scored a victory for ministries' rights with a judgment requiring Maricopa County officials in Arizona to restore complete property tax exemption to Good Friends, Inc., a non-profit Christian ministry. Officials had denied the ministry exemption from county and state property taxes for land which houses the ministry's television production facilities.

* In a major victory for the American Center's defense of the Ten Commandments, a federal court ruling against the ACLU will protect a Mercer County, Ky., courthouse display that includes the TEN COMMANDMENTS. We argued for the defendant, Mercer County, and are involved in more than 15 similar Ten Commandments cases nationwide.

* The American Center filed a major brief with the U.S. Court of Appeals for the Ninth Circuit supporting the sanctity of life and condemning those who take life through physician-assisted suicide in Oregon.

At stake is Attorney General John Ashcroft's directive stating that assisting in suicide is not a "legitimate medical purpose" and that physicians who prescribed lethal drugs would lose their licenses to prescribe federally controlled drugs.

* The same man who launched the lawsuit against our Pledge of Allegiance has filed two other lawsuits in an outrageous attempt to clear the federal government of any reference or connection to God! In every one of these new cases, we will file major briefs fighting for our Constitution and protecting our religious liberties

We have an incredible caseload as the high court is back in session - and I need your fervent prayer and financial support!

This week begins one of the MOST IMPORTANT Supreme Court terms in history because of the huge breadth and importance of cases impacting you and your family - from internet pornography, to national security and terrorism, to a crucial pro-life case.

We are involved in SEVERAL CRITICAL CASES that will be heard later this year:

* We have already filed a brief in a very different case, United States v. Recio, in which the U.S. Court of Appeals for the 9th Circuit established what could be used as a LOOPHOLE FOR TERRORISTS caught plotting murderous acts of destruction!

* We are preparing to file a brief in support of the Justice Department's appeal before the Supreme Court to review a lower court's ruling that the Child Internet Protection Act is unconstitutional.

* Our first battle is actually just days away - the final brief on Case #01-1119, Operation Rescue v. National Organization for Women (N.O.W.), is due October 18. This is the SINGLE MOST IMPORTANT combined pro-life and free speech case in a decade.

We are also working on several more cases that I believe will ultimately come before the high court of the land:

* In Newdow v. U.S. Congress, in which the Ninth Circuit Court of Appeals ruled that the phrase "One nation under God" is unconstitutional in the Pledge of Allegiance, we have filed an AMICUS BRIEF on behalf of the American Center and 17 U.S. members of Congress supporting the Justice Department's petition for a rehearing before the Ninth Circuit.

* A federal appeals court decided that the state of Washington engaged in RELIGIOUS DISCRIMINATION by denying a student a state scholarship just because his chosen major was theology. The state has requested a rehearing. We will prepare the necessary legal documents whether the case goes back to the Ninth Circuit Court of Appeals or to the Supreme Court of the United States.

* If the high court agrees to hear Detroit Free Press v. Ashcroft this term, we will prepare a major brief in support of the Attorney General's position defending the safety of our country - and our families. This could be a major national security case.

Under Sen. Daschle's Senate leadership, the Democratic majority on the Senate Judiciary Committee has grossly politicized the judicial nomination process. They REJECT conservative nominees without a fair hearing or allowing a full Senate vote!

Now the committee is considering the nomination of Michael McConnell and Miguel Estrada.

The American Center for Law and Justice supports the nomination of both men. I'm in Washington, D.C. working with our senior team and key government leaders to develop a strategy so we get President Bush's judicial nominees fair hearings. Before the Senate recess, we must push them to end the logjam in the judicial nomination process.

We've seen the committee's politicization against Charles Pickering and Priscilla Owen, both well-qualified, respected jurists nominated by the President. But they were also conservative, pro-life judges -

- and that was enough for the committee to DEFEAT their nomination along party lines!

I DO NOT WANT TO SEE THIS HAPPEN AGAIN TO MICHAEL MCCONNELL AND MIGUEL ESTRADA.

Both men have been given a "well-qualified" rating by the American Bar Association. And they would serve this country well in the U.S. Court of Appeals.

But the opposition is already growing ...

People for the American Way, the ACLU, Planned Parenthood, N.O.W., and others are RELENTLESS in their fight to keep conservatives out of the federal judiciary.

And it looks like the Democrats on the Senate Judiciary Committee are ready to continue their POLITICALLY PARTISAN BATTLE to defeat Bush nominees ... with the approval of the Senate Majority Leader Daschle.

It is a disgrace for Senate Democrats to continue their strategy of delay and defeat when it comes to President Bush's judicial nominations.

With too many vacancies in the federal courts, unresolved cases are piling high. We must get the judicial logjam broken up!

And remember - these battles over federal court nominees like McConnell and Estrada are just a TASTE of what will come when there is a vacancy on the Supreme Court of the United States.

So we must stand up to these Senators' political strategies ... for the sake of justice and liberty for generations to come!
