The Representative Will of the People: Ignored
In 1996, America’s elected officials in the United States
Congress voted to pass the federal Defense of Marriage Act (DOMA),
which defined marriage as “a legal union between one man and one
woman as husband and wife.” The law also defined a spouse as
being “a person of the opposite sex who is a husband or a wife.”
Thirty-seven state legislatures have also passed similar DOMA
laws, which serve to prevent out-of-state same-sex “marriages”
from being recognized in each respective state. In addition,
recent polls suggest that the overwhelming majority of Americans
are opposed to homosexual marriage. In an Associated Press poll,
59 percent of those polled opposed same-sex marriages, while
only 32 percent favored these marriages.
Regardless, the Massachusetts judiciary has snubbed their nose
at this new federal legislation; they have arrogantly ignored
the will of the people. This is not an isolated event for the
judiciary. Time and time again, America’s appointed judges have
“overruled” this nation’s elected officials.
